In February 2009, the American Recovery and Reinvestment Act (also known as the Recovery Act) was signed into law with the intention of creating new jobs, encouraging economic activity, and holding the government responsible for its spending. Departments and agencies who request or receive public funds through the Recovery Act are responsible for using the funds in a responsible, transparent manner while optimizing the funds for long-term benefit and economic growth. Each applicant is expected to submit a budget plan to Congress detailing how any assistance received will be utilized in projects that follow the intent and goals of the Recovery Act.

The Office of Management and Budget (OMB) and the Environmental Protection Agency (EPA) have issued draft guidance documents regarding the American Recovery and Reinvestment Act–Buy American (ARRA-BA) provision.
